29 CFR 1910.134(d)(1)(iii): The employer did not identify and evaluate the respiratory hazard(s) in the workplace; including a reasonable estimate of employee exposures to respiratory hazards and identification of the contaminants chemical state and physical form.    Air contaminant monitoring was not available for employee(s) exposed to high levels of carbon monoxide from a gasoline powered pump and propane forklift exhaust in the DEF production/warehouse area. On December 7, 2013, an employee suffered severe carbon monoxide poisoning from the unmonitored atmosphere in his work area.

29 CFR 1910.1000(a)(2): Employee(s) were exposed to an airborne concentration of carbon monoxide listed in Table Z-1 in excess of the 8 hour Time-Weighted Average concentration of 50 parts per million.    On December 7, 2014, employee(s) working in the DEF production/warehouse area were exposed to carbon monoxide levels that exceeded the permissible exposure limit listed in Table Z-1 of 29 CFR 1910.1000. An employee suffered carbon monoxide poisoning and had a post exposure carboxyhemoglobin blood level of 28.5%.
