OSH ACT of 1970 Section (5)(a)(1): OSH ACT of 1970 Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by hazards when exiting the operator's/drivers position onto live lanes of traffic: a) Near 6732 New Sulfer Springs Rd, San Antonio, TX 78222, on or about January 07, 2014, employees were exposed to struck-by hazards when stepping out of the operator's/driver's position in the vehicle onto live traffic lanes, while refuse collection operations are in progress; b) Near 23919 Wimberly Oaks, San Antonio, TX, 78261, on or about December 10, 2013, employees were exposed to struck-by hazards when stepping out of the operator's/driver's position in the vehicle, onto live lanes of traffic while refuse collection operations were in progress.

29 CFR 1904.32(a)(1): A review of the OSHA Log of Recordable Work-Related Injuries and Illnesses (OSHA Form 300 or equivalent) was not completed to ensure the Log was accurate and complete, and/or deficiencies were not identified and corrected at the end of each calendar year. Tiger Sanitation did not record the following workplace injury correctly on the OSHA Form 300 for calendar year 2013: a) The employer does not ensure that entries on the OSHA Form 300 are complete and accurate or corrections are made to any deficiencies identified. This violation occurred on or about December 31, 2013 when employee 10 (Driver) obtained a fractured lower leg injury on December 10, 2013. The employee was struck by on-coming high speed traffic when stepping out of the operator's position to help with emptying trash containers. The description of the injury in Column (F) was incomplete, not having the object/substance that directly injured or made person ill.
