OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by falling steel storage racks and/or the products stored on the racks.     (a) Location - Building 3 warehouse:   On or about 1/9/14, employees were exposed to the hazard of being struck by collapsing steel storage racks, including any products stored on them, while loading, unloading and working near damaged racks.  Some racks were not securely fastened to the floor.

29 CFR 1904.29(b)(3): Each recordable injury or illness was not entered on the OSHA 300 Log and/or an incident report (OSHA Form 301or equivalent) within seven (7) calendar days  of receiving information that a recordable injury or illness has occurred:    Location - Establishment:  On or about 1/9/14, the employer failed to record the following instances within seven calendar days:    (a) Case # 21- On or about 10/22/13, an employee received a repetitive injury to left wrist which resulted in two lost work days and thirty-nine restricted duty days.  This injury was not recorded on the OSHA 300 log until on or about January 9, 2014.    (b) Case # 22- On or about 11/13/13, an employee received a laceration on left middle finger which resulted in medical treatment.  This injury was not recorded on the OSHA 300 log until on or about January 9, 2014.    (c) Case # 23- On or about 12/9/13, an employee received a right arm injury from a fall which resulted in 2 lost work days and twenty-seven restricted duty days.  This injury was not recorded on the OSHA 300 log until on or about January 9, 2014.    (d) Case # 24- On or about 12/9/13, an employee received a left pinky laceration which resulted in medical treatment.  This injury was not recorded on the OSHA 300 log until on or about January 9, 2014.
