OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to hazards associated with being crushed or struck by falling objects as a result of damaged storage racks.      (a)  Main Warehouse - On or about January 16, 2014, storage racks used for the storage of pallets of candle making supplies were not installed so as to prevent damage or collapse of the racks in that no less than two (2) support columns were damaged as a result of from being struck by lift trucks and no less than, thereby exposing employees to the hazard of being struck or crushed by unsecured rack components and stored materials while working in the vicinity of the overhead storage.   ABATEMENT NOTE: Among other methods, one feasible and acceptable abatement is to follow the manufacturer's installation instruction and to ensure the structural integrity of the storage racks is maintained through a program of routine inspections to identify those conditions that require repair and/or replacement of missing or damaged parts in accordance with ANSI Standard MH16.1-2008 (Specification for the Design, Testing, and Utilization of Industrial Steel Storage Racks and Commentary to ANSI Standard MH16.1-2008, which requires that every column base-plate be anchored with at least one anchor, and recommends the installation of column protection devices.

29 CFR 1910.37(a)(3): Exit route(s) were not kept free and unobstructed:  (a)  Production Area - On or about January 16, 2014 an exit route was partially obstructed by items stored in front of the exit discharge, to include a sealing machine, a 55-gallon drum, empty boxes, and fluorescent light bulbs.

29 CFR 1910.147(c)(7)(i): The employer did not provide training to ensure that the purpose and function of the energy control program are understood by employees and that the knowledge and skills required for the safe application, usage, and removal of the energy controls are acquired by employees:  (a)  Throughout Facility - On or about January 16, 2014, employees who perform servicing and maintenance on equipment and machinery with hazardous energy sources were not provided with training to the authorized level, in that they were not trained in the recognition of applicable hazardous energy sources, the type and magnitude of the energy available in the workplace, and the methods and means necessary for energy isolation and control.  (b)  Throughout Facility - On or about January 16, 2014, operators of equipment and machinery with hazardous energy sources were not provided with training to the affected level, in that they were not instructed in the purpose and use of the energy control procedure.  (c)  Throughout Facility - On or about January 16, 2014, all other employees whose work operations are or may be in an area where energy control procedures may be utilized, were not instructed about the procedure, and about the prohibition relating to attempts to restart or reenergize machines or equipment which are locked out or tagged out.
