OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck-by the swivel hook used with a 60 feet sling to pull railcars.     On or about 11/12/2013 at still yard filler off load area, employee operating the capstan winch with a 60 feet sling and swivel hook was struck-by the hook that was not centered in the base saddle of the wheel-axle assembly of the railcar.     Among other methods, one feasible and acceptable means of abatement include, but not limited, to:     Following the operation practices in The American Society of Mechanical Engineers (ASME b30.10-2009), Hooks: Safety Standard for Cableways, Cranes, Derricks, Hoists, Hooks, Jacks, and Slings addresses operating practices for Single-Point Hooks. Section 10-1.11.1 Single-Point Hooks status the following; Personnel using hooks shall be aware of the of the following: Paragraph (c) Load shall be centered in the based (bowl/saddle) of the hook to prevent point loading of the hook.
