29 CFR 1910.95(d)(1): A representative monitoring program was not developed and implemented when information indicated that an employee's exposure may equal or exceed an 8 hour time weighted average of 85 dBA:     J.C. MacElroy Co. Inc.,/Piscataway, NJ- Shop Area: The employer did not monitor noise exposure for employees working in the production area and exposed to continuous noise levels of 87.10 dBA for an 8-hour TWA,  which is equivalent to dose of  67.14%.  This level exceeded OSHA Action Level of 85 dBA. Sampling time was 476 minutes and zero exposures were assumed for all unsampled time periods.    Condition observed on or about January 13, 2014.

29 CFR 1910.95(g)(1): The employer did not establish and maintain an audiometric testing program as provided by 29 CFR 1910.95(g) by making audiometric testing available to all employees whose exposures equal or exceed an 8-hour time-weighted average of 85 decibels:   J.C. MacElroy Co. Inc.,/Piscataway, NJ- Shop Area:  The employer did not establish and maintain an audiometric testing program for employees working in the production area and exposed to continuous noise levels of 87.10 dBA for an 8-hour TWA,  which is equivalent to dose of  67.14%. Employees are exposed to chemicals, such as but not limited to:   - Aliphatic Hydrocarbons Solvent, VM&P Naphtha and Acetone contained in OPEX Lacquer Thinner,  - Isopropanol contained in Carboline, Thinner #21  - Toluene and Methyl Ethyl Ketone, contained in Carboline, Thinner #2    Condition observed on or about January 13, 2014.

Inc., was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.134(e)(1), which was contained in OSHA inspection number 313984791, citation number 1, item number 1b and was affirmed as a final order on 4/01/2011, with respect to a workplace located at 91 Ethel Road West, Piscataway, NJ 08854.
