29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employee(s) was/were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety. JOBSITE: The employees, who were shoveling and replacing a broken water main in the trench where there were several hazardous conditions, such as (but not limited to) water accumulation in the trench, soil/material placed at the edge of the trench and more were not removed from the trench.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c). The employer had not complied with the provisions of 29 CFR 1926.652(b)(1)(i) in that the trench was not equipped with shoring or sheeting to prevent a cave-in: JOBSITE: The employees, replacing a broken water main in the approximately 5 feet to 5 feet 4 inches deep trench were not protected from the hazard of trench cave-ins by the use of appropriate trench cave-in protection devices, systems and/or other safe and effective methods. A.J. Penna & Son Construction Inc. was previously cited for a violation of this occupational safety and health standard {29 CFR 1926.652(a)(1)}, which was contained in OSHA inspection number 315338426, citation number 01, item number 002, issued on 06/22/2011 and was affirmed as a final order on 07/06/2011, with respect to a workplace located at Henry St. & Pacific St., Stamford, CT 06902. A.J. Penna & Son Construction Inc. was previously cited for a violation of this occupational safety and health standard {29 CFR 1926.652(a)(1)}, which was contained in OSHA inspection number 313516221, citation number 02, item number 001, issued on 10/27/2009 and was affirmed as a final order on 11/27/2009, with respect to a workplace located at 1114 East Putnam Ave., Greenwich, CT 06830.
