29 CFR 1910.23(c)(1): Open-sided floors and/or platforms four feet or more above adjacent floor or ground level were not guarded with standard railings (or equivalent) and toeboards: (a) MCHM Loading and Storage Area: Employees access an elevated platform measuring 4 feet 7 inches above ground level to cross over the diked wall. The elevated platform was not equipped with standard railings, as evident on January 10, 2014. Abatement Certification Required for this Item. Note: Toeboards are only required when persons can pass, there is moving equipment or there is equipment with which falling materials could create a hazard.

29 CFR 1910.106(b)(2)(vii)(c)(3): Walls of the diked area were not designed to be of earth, steel, concrete or solid masonry and to be liquid tight and to withstand a full hydrostatic head: (a) MCHM Storage Tanks: The masonry constructed diked wall surrounding three above ground storage tanks containing MCHM was not liquid tight. On January 9, 2014 approximately 10,000 gallons of MCHM leaked from tank 396 and escaped through the riverside diked wall, as determined on January 10, 2014.

29 CFR 1910.1200(f)(5)(i): The employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged or marked with the identity of the hazardous chemical(s) contained therein: (a) MCHM Tank Area: The employer did not ensure that a 52,000 gallon capacity above ground storage tank (Tank # 395) containing MCHM was properly labeled to identify the product. The MCHM containing tank was labeled as Glycerin, as determined on January 10, 2014.
