OSH ACT of 1970 Section (5)(a)(1) : The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that the employees were exposed to struck by hazards.     Location: 1119 Atlantic Ave., Brooklyn, NY.     On or about 1/12/14.     a) At the car wash facility; Employees were exposed to struck-by hazards on the job. An unlicensed employee drove a vehicle (SUV) from the car wash stall with the door open to the sidewalk where it was going to be dried off.  The vehicle accelerated towards the adjacent street (Atlantic Ave), and collated with a passing vehicle. The collision ejected the employee from the SUV, which then ran him over.        AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARD IS:        1. Develop and implement a company policy that employees must operate vehicles with all doors closed.    2. Ensure that all employees have a valid motor vehicle license prior to being allowed to operate vehicles in accordance with NY Vehicle and Traffic Law 509: NY Code Section 509.
