29 CFR 1926.451(b)(1): Each platform on all working levels of scaffolds was not fully planked or decked between the front uprights and the guardrail supports as follows:   (a) Center of Building - On or about December 23, 2013 two employees were exposed to a fall hazard due to a scaffold not being fully decked or planked. Employees were working 46 feet above the ground.

29 CFR 1926.451(c)(1)(ii): Guys, ties, and braces were not installed according to the scaffold manufacturer's recommendations or at the closest horizontal member to the 4:1 height and be repeated vertically at locations of horizontal members every 20 feet (6.1 m) or less thereafter for scaffolds 3 feet (0.91 m) wide or less, and every 26 feet (7.9 m) or less thereafter for scaffolds greater than 3 feet (0.91 m) wide. The top guy, tie or brace of completed scaffolds shall be placed no further than the 4:1 height from the top. Such guys, ties and braces were not installed at each end of the scaffold and at horizontal intervals not to exceed 30 feet (9.1 m) (measured from one end [not both] towards the other):   (a)  Construction Site - On or about December 23, 2013 employees were exposed to a fall from a height of 46 feet above the ground due to the frame of the scaffold not being tied to the building.

29 CFR 1926.451(e)(1): When scaffold platforms are more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface was not used. Crossbraces shall not be used as a means of access:   (a)   Construction Site - On or about December 23, 2013 six employees were exposed to a fall hazard while climbing on a welded metal frame scaffold.  Employees would fall up to 46 feet to a lower level. Employees were not provided an access ladder.

29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet (3.1 m) above a lower level was not protected from falling to that lower level. Paragraphs (g)(1)(i) through (vii) of this section establish the types of fall protection to be provided to the employees on each type of scaffold. Paragraph (g)(2) of this section addresses fall protection for scaffold erectors and dismantlers.  Note to paragraph (g)(1): The fall protection requirements for employees installing suspension scaffold support systems on floors, roofs, and other elevated surfaces are set forth in subpart M of this part:   (a) 7th Floor, Scaffold - On or about December 23, 2013 two employees were exposed to a fall hazard while standing on a scaffold 46 feet above ground. Employees were not protected from falling to a lower level by a guardrail system, personal fall arrest system or safety net system.       (b) 3rd Floor, Scaffold - On or about December 23, 2013 three employees were exposed to a fall hazard while standing on a scaffold 20 feet above ground. Employees were not protected from falling to a lower level by a guardrail system, personal fall arrest system or safety net system.       (c) 4th Floor, Scaffold - On or about December 23, 2013 an employee was exposed to a fall hazard while standing on a scaffold 27 feet above ground. Employees were not protected from falling to a lower level by a guardrail system, personal fall arrest system or safety net system.

29 CFR 1926.454(a): The employer shall have each employee who performs work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards. The training shall include the following areas, as applicable:   (a)  Construction Site - On or about December 23, 2013 six employees were exposed to a fall hazard while working on scaffolds. Employees were not provided training on how to recognize, prevent and minimize fall hazards associated scaffolds.
