29 CFR 1910.106(d)(3)(ii)(a): Metal cabinets constructed in the following manner shall be deemed to be in compliance. The bottom, top, door, and sides of cabinet shall be at least No. 18 gage sheet iron and double walled with 1 1/2 - inch air space. Joints shall be riveted, welded or made tight by some equally effective means. The door shall be provided with a three-point lock, and the door sill shall be raised at least 2 inches above the bottom of the cabinet. The employer failed to protect employees from potential fire hazards associated with storing flammable aerosols in an inadequate container. This was most recently evident during the inspection of the facility located at 610 West 4th Street, Snyder, NE 68664, where the employer has employees storing various aerosol and other flammable products inside a metal cabinet that was not designed for this purpose and would not meet the fire rating requirements as outlined in the NFPA. Instances of inadequacies include but are not limited to: i. The bottom, top, door and sides of cabinet shall be at least No. 18 gauge sheet iron and double walled with 1 ½ inch air space. ii. Joints shall be riveted, welded or made tight by some equally effective means. iii. The door shall be provided with a three-point lock and the door sill shall be raised at least 2 inches above the bottom of the cabinet.

29 CFR 1910.147(c)(6)(ii): The employer did not certify that periodic inspections of the energy control procedures had been performed: The employer failed to protect employees from potential electrical, caught between and struck by hazards associated with performing maintenance on a piece of equipment requiring lockout and tag out for maintenance without having certified the annual periodic review of the written specific procedures had been performed within the past year. This was most recently evident during the inspection of the facility located at 610 West 4th Street, Snyder, NE 68664, where the employer has employees exposed to hazards as a result of failing to document the annual periodic reviews, continuously performing maintenance on equipment while using unverified written specific procedures.
