29 CFR 1910.178(l)(2)(ii): The employer did not ensure that each operator had successfully completed the training consisting of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace. (a) On or about January 13, 2014, employees exposed to tip over hazards operating powered industrial vehicles such as but not limited to; the Mitsubishi Model FD45, SN. AF17D01065 powered industrial truck(s) and the truck #72, Sterling Cab, Mercedes Engine, 24' truck with a 49' boom within the lumber yard were not properly trained on the safe operation of powered industrial vehicles including the use of seatbelts, setting the brakes properly on the Sterling Cabs and ensuring the blocking of wheels during loading and unloading of material.

29 CFR 1910.178(l)(4)(ii): The employer did not provide refresher training to all employees engaged in the unsafe operation and use of forklifts: (a) Employees operating powered industrial vehicles such as but not limited Mitsubishi powered industrial trucks to move materials in the lumber yard were not properly provided with refresher training in the safe operations of the powered industrial trucks and included in the Mitsubishi Operation and Maintenance Manual.
