29 CFR 1910.23(c)(1): Open-sided floors and/or platforms four feet or more above adjacent floor or ground level were not guarded with standard railings (or equivalent) and toeboards: a) Production Area, Power Screen: Employees were adding ingredients to the power screen on a platform greater than 4 feet above the ground level and a standard railing was not present by the pallet exposing the employee to fall hazards, on or about January 15, 2014. b) Production Area, H2 Mixer: An employee working on the top of the mixer which is greater than 4 feet above the ground level was exposed to fall hazards due to the lack of a midrail on the railing system and no standard railing at the open edge of the working platform, on or about January 15, 2014. Note: Toeboards are only required when persons can pass, there is moving equipment or there is equipment with which falling materials could create a hazard. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states that employees and their representatives were informed of this abatement.

29 CFR 1910.1200(h)(3)(iv): The details of the hazard communication program developed by the employer, did not include an explanation of the labels received on shipped containers and the workplace labeling system used by their employer; the safety data sheet, including the order of information and how employee could obtain and use the appropriate hazard information: a) Facility wide: Employees working with ingredients including sodium nitrate and flammables were not provided the new labeling information and safety data sheet structure, on or about January 15, 2014. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states that employees and their representatives were informed of this abatement.
