29 CFR 1926.451(e)(1): When scaffold platforms are more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface shall be used. Crossbraces shall not be used as a means of access: On or about 1/14/2014, in front of the Conn's Furniture,located at 7981 Youree Drive, Bossier City, Louisiana the employer allowed employee( s )to acend and descend the tubular welded frame scaffolding with out an access ladder.

29 CFR 1926.451(g)(1)(vii): For all scaffolds not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, each employee shall be protected by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section. On or about 1/14/2014, in front of Conn's Appliance located at 7981 Youree Drive, Bossier City, Louisiana , the employer allowed employees to work on a tubuular welded frame scaffolding at a height of twelve feet without a personal fall arrest system or guardrail system on the open ends of the platforms.
