OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a struck-by hazard: On or about January 14, 2014, in the Mixing Room, employees were exposed to the hazard of being struck by loads of meat weighing up to 400 Lbs. because of an unrated trolley acting as the support structure of the electric chain hoist. Among other methods , one feasible and acceptable method to abate the hazard includes, but is not limited to the applicable elements recommended and required by ANSI B30.16 Chapter 16-2, Electric or Air Powered Hoists 16-2.1.3.6 Support.

29 CFR 1910.212(a)(1): Types of guarding. One or more methods of machine guarding shall be provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks. On or about January 14, 2014, in the Mixing Room, the employer allowed employees to utilize the Buffalo Mixer Unit with the gear sprockets unguarded and within the zone of exposure of the employees.
