29 CFR 1926.454(a): The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards. On or about January 15, 2014, in front of the sprint store, an employee was observed working off the mid-rails of an elevated boom crane basket with his lanyard attached to the top-rail. The employer did not instruct the employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment. The employee was exposed to a fall hazard of greater than ten feet.

29 CFR 1926.502(d)(23): Personal fall arrest systems were attached to guardrail systems: On or about January 15, 2014, in front of the Sprint store, an employee was observed working off the mid-rails of an elevated boom crane basket with his personal fall protection harness and lanyard attached to the top-rail of the basket. Anchor points located on each side of the basket floor platform were not used. The employee was exposed to a fall hazard of greater than ten feet.
