29 CFR 1926.100(a): Employees were not protected by protective helmets while working in areas where there was a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns:  On or about January 15, 2014, two employees plastering the walls of the house under construction were observed working on scaffolds that were not equipped with toeboards. Two employees observed working below were not utilizing head protection. This condition exposed employees to struck-by hazards.

29 CFR 1926.451(f)(7): Scaffolds were not erected, moved, dismantled, or altered, by trained and experienced employees under the supervision and direction of a competent person qualified in scaffold erection, moving, dismantling or alteration. Such activities were not performed only by experienced and trained employees selected for such work by the competent person:  On or about January 15, 2014, on both sides and behind the house under construction, employees erected, dismantled and moved the scaffolds at the work site without supervision and direction of a competent person qualified in scaffold erection. Employees were exposed to fall and struck-by hazards.

29 CFR 1926.451(c)(2): Supported scaffold poles, legs, posts, frames,  or uprights did not bear on base plates, mud sills or other adequate firm foundation:  On or about January 15, 2014, the scaffolds erected to the right side and behind the house under construction did not bear baseplates and/or mudsills. The scaffold baseplates were directly set on uneven ground. The employees were exposed to fall hazards from unstable scaffolds.  Beltran Plastering was previously cited for a violation of this occupational safety and health standard 1926.451(c)(2), which was contained in OSHA inspection number 895394, citation number 001, item number 002a and was affirmed as a final order on October 7, 2013, with respect to a workplace located at 5800 North Mesa, El Paso, TX 79912.

29 CFR 1926.451(e)(1): A means of access for scaffold platforms more than 2 feet (0.6 m) above or below a point of access, such as portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface was not used:  On or about January 15, 2014, to the right of the house under construction, one employee was observed climbing down from a scaffold without the use of a ladder. The employee was exposed to slip and fall hazards from the lack of scaffold access.    R. Beltran Plastering was previously cited for a violation of this occupational safety and health standard 1926.451(e)(1), which was contained in OSHA inspection number 313500845, citation number 001, item number 002 and was affirmed as a final order on August 23, 2011, with respect to a workplace located at 7501 North Mesa, El Paso, TX 79912.

When the falling objects are too large, heavy or massive to be contained or deflected by any of the above-listed measures, the employer shall place such potential falling objects away from the edge of the surface from which they could fall and shall secure those materials as necessary to prevent their falling:  On or about January 15, 2014, employees plastering the walls of the house under construction were observed working with plastering tools and heavy plastering materials set on top of scaffolds, which were not equipped with toeboards. Two employees observed working below were not utilizing head protection. This condition exposed employees to struck-by hazards.    Rafael Beltran Plastering was previously cited for a violation of this occupational safety and health standard 1926.451(h)(1), which was contained in OSHA inspection number 895394, citation number 001, item number 001c and was affirmed as a final order on October 7, 2013, with respect to a workplace located at 5800 North Mesa, El Paso, TX 79912.
