29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees:  (a)  A trench located within the right-of-way at 4227 East Kearney, Springfield, Missouri, was in excess of 4 feet deep and was not provided with a ladder for employee egress.  The employer provided evidence that the trench was filled in on 01/15/2014.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c). The employer had not complied with the provisions of 29 CFR 1926.652(b)(1)(i) in that :  (a)  At the corner of 4727 East Kearney, employees were exposed to a trench cave in since no cave in protection had been provided by the employer.  The trench was fourteen feet long, six feet wide and six feet deep.  The trench was closed on 01/15/2014.
