29 CFR 1926.453(b)(2)(iv): Employees shall always stand firmly on the floor of the basket, and shall not sit or climb on the edge of the basket or use planks, ladders, or other devices for a work position.  a. The employee was taken to the roof in a telescopic boom aerial lift at which point he exited the lift over the railing to access the roof. The employee was exposed to a fall hazard of 25 feet.

29 CFR 1926.453(b)(2)(v): A body belt shall be worn and a lanyard attached to the boom or basket when working from an aerial lift. Note to paragraph (b)(2)(v): As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under 1926.502(e).  a. An employee on the north end of the building was transported to the roof and back to the ground in a telescopic boom aerial lift without fall protection, thereby exposing the employee to a 25 foot fall hazard.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.  a. The employer failed to ensure that employees working on the roof of the hotel had fall protection; the employees were exposed to a fall hazard of approximately 25 feet.

29 CFR 1926.502(d)(17): The attachment point of the body belt shall be located in the center of the wearer's back. The attachment point of the body harness shall be located in the center of the wearer's back near shoulder level, or above the wearer's head.  a. An employee was observed operating a telescopic boom aerial lift on the north end of the building while improperly wearing his harness. The harness D ring attachment point was located in the small of the employees back exposing the employee to fall hazard related injuries.
