29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: (a) For employees working at the production shed at 19400 Peachland Blvd., Port Charlotte, FL 33948, as noted on or about 01/16/2014. No written hazard communication program was in place for slag cement and masonry cement that is used in the cement mixing process; some of the components that are in the cement are amorphous silica, and crystalline silica.

29 CFR 1910.134(c)(2)(i): Respirator users were not provided with the information contained in Appendix D to 29 CFR 1910.134 when the employer determined that any voluntary respirator use was permissible: (a) For employees working in the concrete structure production shed at 19400 Peachland Blvd., Port Charlotte, FL 33948, as noted on or about 01/16/2014. Employees are offered an N95V dust mask without having been provided the Appendix D information. The dust masks are used during the cement mixing process, and drilling of concrete structures.
