29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: (Construction Reference: 1926.59) a.) Wm. T. Spaeder Company, Inc., 3700 PA Route 957, Russell, PA, on or about January 14th, 2013, and times prior thereto: Company employees were working with and around hazardous substances including but not limited to, Weld-On Plumbing Purple Low VOC Primer and PB Penetrating Catalyst. The company's Hazard Communication Program did not include the following items related to MSDS: 1)The method employees can utilize to obtain access to the Material Safety Data Sheets at a worksite other than via the onsite foremen's IPAD and; 2) The back-up system to be used to obtain MSDSs in the event of a failure to the electronic equipment utilized to obtain MSDSs.

29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area: (Construction Reference: 1926.59) a.) Wm. T. Spaeder Company, Inc., 3700 PA Route 957, Russell, PA, on or about January 14th, 2013, and times prior thereto: Company employees were working with and around hazardous substances including but not limited to, Weld-On Plumbing Purple Low VOC Primer and PB Penetrating Catalyst. Employees were not provided effective Hazard Communication training as evidence by the fact that employees were not aware of the following items: 1) Operations in their work area where hazardous chemicals are present; and, 2) The location and availability of the written hazard communication program, including the required list of hazardous chemicals, and material safety data sheets; 3) The physical and health hazards of the chemicals in the work area.
