29 CFR 1926.451(g)(1): Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section:  a)  Work Site:  123 River Street, Jersey City, NJ - North elevation (Grand Avenue)  Employer allowed his employees to work on a Werner Aluminum Pump Jack Scaffold System Model # WNS-2424 at height of approximately 30 feet from the ground below with no fall protection system in place, exposing them to fall hazards.  Violation observed on or about January 13, 2014.

29 CFR 1926.502(d)(6)(ii): Unless a snaphook is of the locking type and designed for the following connections, shall not be engaged to each other:   a)  Work Site:  123 River Street, Jersey City, NJ - North end roof  Employees engaged in exterior water-proofing activities were observed utilizing two lanyards connected together by the snaphooks which were not designed for that purpose.  Violation observed on or about January 27, 2014.

29 CFR 1926.1053(b)(4): Ladder(s) were used for purposes other than the purpose for which they were designed:  a)  Work Site:  123 River Street, Jersey City, NJ - North end roof  A 6 foot Husky A-frame ladder was used in a manner not intended by the manufacturer.  Employees used an A-frame ladder in the closed position as access over the parapet wall to perform waterproofing activities to the exterior parapet wall.  Violation observed on or about January 27, 2014.

29 CFR 1926.1053(b)(16): Portable ladders with structural defects, such as, but not limited to, broken or missing rungs, cleats, or steps, broken or split rails, corroded components, or other faulty or defective components, were not either immediately marked in a manner that readily identifies them as defective, or tagged with "Do Not Use" or similar language, and were not withdrawn from service until repaired.  a)  Work Site:   123 River Street, Jersey City, NJ - North end roof  An A-frame ladder with structural defects was not taken out of service.  Employees used an A-frame ladder that had damaged steps and broken side rails as a means to access their work.  Violation observed on or about January 27, 2014.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.  a)  Work Site:   123 River Street, Jersey City, NJ - North end roof - Parapet Wall  Employees were not protected from falling by use of a personal fall arrest system.  Employees engaged in exterior insulation applications were observed working over the parapet wall without the use of fall protection.  Violation observed on or about January 27, 2014.  b)  Work Site: 123 River Street, Jersey City, NJ - Inside Building  Employee working inside building, adjacent to window, was exposed to fall hazard of approximately 20 feet to the ground below as fall protection was not being utilized.   Violation observed on or about January 27, 2014.  c)   Work Site: 123 River Street, Jersey City, NJ - Rooftop  Employee working from the 4th story roof was exposed to fall hazard of approximately 40 feet to the ground below as fall protection was not being utilized.   Violation observed on or about January 27, 2014.   P & B Partitions Incorporated was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501 (b)(1), which was contained in OSHA inspection number 312636012, Citation Number 1, Item Number 1 and was affirmed as a final order on 4/27/2010, with respect to a workplace located at: Longwood at Oakmont, Grandview Apartment Building, Verona, PA 15147.

Violation observed on or about January 27, 2014.   b)  Work Site:  123 River Street, Jersey City, NJ - Parapet Wall/East Side  Employee(s) were exposed to fall hazard while utilizing a lifeline that was rigged to a length that would permit a free fall in excess of 6 feet.  Violation observed on or about January 27, 2014.   P & B Partitions Incorporated was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.502 (d)(16)(iii), which was contained in OSHA inspection number 314725177, Citation Number 1, Item Number 1 and was affirmed as a final order on 8/31/2011, with respect to a workplace located at Rockhill Mennonite Home, 3250 State Road, Sellersville, PA 18960-6624.
