29 CFR 1910.333(c)(3): When work was to be performed near overhead lines, the lines were not deenergized and grounded, nor were other protective measures provided before work was started: On or about January 14, 2014 and prior to that time located at the fill debris pile under energized 138kv transmission line F0886 deenergization, was not provided to prevent conductive materials or operating equipment from getting closer than allowable approach distances to energized overhead lines without the lines being deenergized, grounded and locked/tagged out.

29 CFR 1910.333(c)(3)(i)(A): When an unqualified person is working in an elevated position near overhead lines, the location shall be such that the person and the longest conductive object he or she may contact cannot come closer to any unguarded, energized overhead line than voltages to ground over 50kV - 10 feet (305 cm) plus 4 inches (10 cm) for every 10kV over 50kV. On or about January 14, 2014 and prior to that time located at the fill debris pile under energized 138kv transmission line F0886 conductive materials or operating equipment potential proximity were closer than allowable approach distances to energized overhead lines existed without safety-related work practice procedures and program implemented by a qualified person or the lines being deenergized, grounded and locked/tagged out.
