29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system. a) 403 Trenton Ave, Sea Girt, NJ: Two RW Fisher Construction employees were observed to be working on the upper levels of a residential structure. The workers were not protected by guardrails and were not using fall restraint, PFAS or any other form of fall protection and were thus exposed to fall hazards of greater than 23 feet from the walking working surface to the ground below. Observed on or about 01/16/2014. RW Fisher Construction LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard (29 CFR 1926.501(b)(13)), which was contained in OSHA inspection number 905503, citation number 01, item number 02 a, and was affirmed as a final order on 07/03/2013, with respect to a workplace located at 400 Washington St. Sea Girt, NJ. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
