OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to hazards associated with operating an excavator on uneven loose spoil material without the use of outriggers. (a) Location: Salem State University, Central Campus Parking Lot, Salem MA, 01970 On or about 1/20/2014, the employer failed to ensure that a CAT M322D excavator was operated in accordance with the manufacturers operations and maintenance manual regarding hoisting and the use of equipment outriggers.

29 CFR 1926.602(a)(3)(i): 29 CFR 1926.602(a)(3)(i): The employer moved or caused to be moved construction equipment or vehicles upon an access roadway or grade without ensuring the access roadway or grade was constructed and maintained to safely accommodate the movement of equipment and vehicles. (a) Location: Salem State University, Central Campus Parking Lot, Salem MA, 01970 On or about 1/20/2014, the employer instructed the employee (excavator operator) to maneuver a CAT M322D excavator with pneumatic tires on loose spoil piles, while hoisting a trench box without the use of outriggers, which made the equipment unstable, and caused it to roll over.
