29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents. On or about 16 January 2014, and at times prior thereto, a roofer was installing roofing shingles with a pneumatic nail gun without the use of eye protection, exposing the roofer to the hazard of being struck by flying objects or projectiles.

29 CFR 1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs, with unprotected sides and edges 6 feet (1.8 m) or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or warning line systems and safety monitoring systems. On or about 16 January 2014, and at times prior thereto, five roofers were performing various roofing activities on the second story roof on an apartment complex at an approximate 4 to 12 pitch without the use of fall protection, exposing them to a fall hazard of approximately 16 feet to the ground or concrete below. Alfredo Martinez was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard 29 CFR 1926.501(b)(10), which was contained in OSHA Inspection# 315630186, Citation# 01, Item# 001 and was affirmed as a final order on 4/3/2012, with respect to a workplace located at 8707 Lakeside Parkway, San Antonio, Texas, 78235.
