29 CFR 1926.602(d): Note: The requirements applicable to construction work under paragraph (d) of this section are identical to those set forth at paragraph (l) of 29 CFR 1910.178:       29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator was competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):      a) The employer did not train and evaluate the employee operating the Genie GTH-844 all-terrain forklift.       In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1926.501(b)(13):  Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor  did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:      a)  Employees engaged in carpentry work were not protected from fall hazards while working on the 2nd floor deck approximately 20 feet above the gravel basement floor.       b)  Employees engaged in carpentry work were not protected from fall hazards of approximately 10 feet to the basement while working around unguarded stairway opening.       c)  Employees engaged in carpentry work were not protected from fall hazards approximately 14 feet to the ground while working near wall openings.         In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1926.1053(b)(1): Where (a) portable ladder(s) was/were used for access to an upper level landing surface and the ladder's length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigged support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder:       a)  An extension ladder used by employees to gain access to the working surface was not long enough to have it's side rails extend at least 3 feet above the surface.     No abatement certification or documentation is required for this item.
