29 CFR 1910.178(p)(1): Powered industrial truck(s) found to be in need of repair, defective, or in any way unsafe had not been taken out of service until restored to safe operating condition(s); a.) Kroger Co. located at 7545 Sylvania, Ave. Sylvania, OH 43560; On or about January 23, 2014, the employer did not assure power jacks were taken out of service after being found to be in need of repair. Employees use the Crown power jack to transport groceries to and from the stock room and were exposed to struck by hazards from abrupt stopping of the jack. The Kroger Co. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1910.178(p)(1), which was contained in OSHA inspection number 314590225, citation number 1, item number 1 and was affirmed as a final order on January 12, 2011 with respect to a workplace located at 1840 Columbus Pike Delaware, OH.

Kroger Co. located at 7545 Sylvania, Ave. Sylvania, OH 43560; On or about January 23, 2014, the employer did not assure power jacks were examined before being placed into service. Employees were exposed to struck by hazards from power lift jacks used for transporting groceries, in that pre-operational inspections were not completed. Kroger Co. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1910.178(q)(7), which was contained in OSHA inspection number 890807, citation number 2, item number 1 and was affirmed as a final order on January 17, 2014, with respect to a workplace located at 1428 Marion-Waldo Rd. Marion, OH 43302.
