OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to drowning when employer did not provide barriers, curbs, or other structures to prevent an excavator from falling into the water: a) Weeks 46 Barge: The Caterpillar Model 324 excavator was not prevented from falling into the water. The excavator was not secured to the barge nor were any safeguards such as but not limited to barriers, curbs or other structures provided to prevent the Caterpillar excavator from falling into the water, on or about 3/4/2014.
