29 CFR 1926.1101(d)(5): As supervisor of the entire project, the general contractor did not ascertain whether the asbestos contractor was in compliance with the asbestos standard, and did not require such contractor to come into compliance with this standard:           c)  The YMCA Building, old gym:  On or about January 23, 2014, Kopplow Construction, general contractor did not ascertain whether Bexar Environmental was in compliance with the standard, and did not require such contractor to correct a containment breach while there was class I asbestos abatement occurring exposing sub-contractor employees to airborne asbestos.

29 CFR 1926.1101(k)(1):  Installed Asbestos Containing Building Material.  Employers and building owners did not identify TSI and sprayed or troweled on surfacing materials in buildings as asbestos-containing, unless they determined in compliance with paragraph (k)(5) of this section that the material is not asbestos-containing:         The YMCA Building, old gym:  On or about January 23, 2014 and at times prior to, Kopplow Construction, general contractor did not identify asbestos containing weather proofing material behind concrete masonry unit and did not consider this material presumed asbestos containing material for a building constructed in 1973 exposing subcontract employees to airborne asbestos.

29 CFR 1926.1101(k)(4): Employer who discovered asbestos containing material and/or presumed asbestos containing material on a worksite did not convey information concerning the presence, location and quantity of such newly discovered asbestos containing material and/or presumed asbestos containing material to the owner and to other employer of employees working at the worksite within 24 hours of discovery:        Old Gym:  On or about January 23, 2014 and at times prior to, Kopplow Construction did not inform Quality Remodel of San Antonio (QRSA), a drywall contractor of the presence, location, and quantity of ACM of newly discovered asbestos containing material (ACM) at the worksite until four to five days after the receipt of the report that the CMU and concrete wall in the gym that was cut into and removed had weatherproofing asbestos material.
