On or about January 23, 2014 - at the above addressed jobsite, an inspection was not conducted by a competent person capable of recognizing and correcting impalement hazards associated with falls to the lower level through unprotected sides and edges and floor openings, which could result in employee injuries.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.      a.  On or about January 23, 2014 - at the above addressed jobsite, an employee performing snow removal operations on the third floor deck was not protected from falls and fell through an unprotected floor opening approximately eleven(11) feet down to the lower deck.    b.  On or about December 19, 2013 through January 23, 2014 - at the above addressed jobsite, employees performing carpentry framing operations on the first, second and third floor decks were exposed to falls of approximately eleven (11), sixteen (16), twenty two (22) and twenty seven (27) feet due to the presence of unprotected and/or inadequately protected sides and edges, thereby exposing the employees to fall hazards     c.  On or about December 19, 2013 through January 23, 2014 - at the above addressed jobsite, employees performing carpentry framing operations on the second floor deck were exposed to falls of approximately sixteen (16) feet due to the presence of unprotected and/or inadequately protected window openings, thereby exposing the employees to fall hazards

29 CFR 1926.1053(b)(1): When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grabrail, shall be provided to assist employees in mounting and dismounting the ladder. In no case shall the extension be such that ladder deflection under a load would, by itself, cause the ladder to slip off its support.  a.  On or about January 23, 2014 - at the above addressed jobsite, the portable job made ladder used to access the building did not extend at least three (3) feet above the upper landing surface, thereby exposing employees to the hazards associated with falls.
