OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards when using the elevated ladders that were not inspected on a daily basis nor removed from service when not in proper operating condition:    On or about January 27, 2014, employees were exposed to fall hazards when the Elevated Ladders were not inspected on a daily basis nor removed from service when not in proper operating condition:  a.     Elevated Ladder #2 had a gate latch mechanism that would not latch and the positioning belt label was no longer legible  b.     Elevated Ladder #1 had a positioning belt label that was no longer legible.    AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THESE HAZARDS IS:  To follow American National Standard Institute (ANSI) A92.3-1990, Specification for Manually Propelled Elevating Aerial Platforms, Section 7.3 (Maintenance and Inspection), which states, "Aerial platforms that are not in proper operating condition shall be immediately removed from service until repaired.  Section 7.3.3 states, Before use each day or at the beginning of each shift, the aerial platform shall be given a visual inspection and functional test.
