29 CFR 1926.651(j)(1): Adequate protection was not provided to protect employees from loose rock or soil that could pose a hazard by falling or rolling from an excavation face: (a) On or about January 17, 2014, and at times prior, Concrete Structures, Inc. did not ensure that adequate protection was provided to employees from loose rock or soil that could pose hazards by falling or rolling from an excavation face. Employees were exposed to struck-by hazards while setting up concrete forms for a sewer inlet in an excavation at least 11 feet deep. Loose chunks of soil larger than 6 inches in diameter were observed within 2 feet from the excavation face. Abatement Note: Abatement certification is required for this item (see enclosed "Certification of Corrective Action Worksheet").

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section: (a) On or about January 17, 2014, and at times prior, Concrete Structures, Inc. did not ensure that each employee in an excavation was protected from cave-in hazards by having an adequate excavation protective system. Three employees were exposed to cave-in hazards while setting up concrete forms for a sewer inlet in an excavation at least 11 feet deep without adequate protective systems.
