29 CFR 1910.132(a): Protective equipment was not used when necessary whenever hazards capable of causing injury and impairment were encountered:       (a)Bulk Transporters, Inc. @ 313 9th Street, Gilcrest, CO 80623: On and before September 16th, 2013, the employer did not ensure the use of personal fall arrest systems were required to conduct activities such as, but not limited to, repairing or maintenancing equipment on top of bulk trailers. Employees climbed on top of trailers at heights of approximately 12 feet to service and perform maintenance without adequate fall protective.This condition exposed the employees to fall hazards of approximately 12 feet while working on top of the trailers.

29 CFR 1910.146(c)(1):  The employer did not evaluate the workplace to determine if any spaces were permit-required confined spaces:     (a) Bulk Transporters, Inc. @ 313 9th Street, Gilcrest, CO 80623; On and before January 29, 2014, the employer did not evaluate the workplace to determine if any spaces were permit-required confined spaces at the facility.  Specifically, employees entered and performed maintenance activities within 7000 gal bulk trailers with a 20" inch access port located on top of the tanker trailer without evaluating the space to decide if they are permit required confined spaces.     Abatement Note:  "Confined space" means a space that:       (1)Is large enough and so configured that an employee can bodily enter and perform assigned work; and       (2)Has limited or restricted means for entry or exit (for example, tanks, vessels, silos, storage bins, hoppers, vaults, and pits are spaces that may have limited means of entry.); and       (3)Is not designed for continuous employee occupancy.       If it is determined that employees will not enter permit spaces, the employer shall take effective measures to prevent its employees from entering the permit spaces and shall comply with 29 CFR 1910.146(c)(1), (c)(2), (c)(6), and (c)(8).       If it is determined that employees will enter permit spaces, the employer shall develop and implement a written permit space program that complies with 29 CFR 1910.146. The written program shall be available for inspection by employees and their authorized representatives.

The condition exposed employees to atmospheric hazards of entering permit required confined spaces without those spaces having been adequately evaluated for potential hazards.

29 CFR 1910.146(k)(3)(i): Each authorized entrant did not use a chest or full body harness, with a retrieval line attached at the center of the entrant's back near shoulder level, or above the entrant's head:      (a) Bulk Transporters, Inc @ 313 9th Street, Gilcrest, CO 80623: On and before January 29th, 2014, the exposing employer did not ensure each authorized entrant, specifically the authorized entrants performing maintenance activities in the bulk tanks, used a chest or full body harness, with a retrieval line attached at the center of the entrant's back near shoulder level, or above the entrant's head to facilitate non-entry rescue. The condition exposed an employee to entrapment within the bulk tank.

(a) Bulk Transporters, Inc., 313 9th Street, Gilcrest, CO 80623; On and before January 29, 2014, the exposing employer failed to train his employees on the hazardouse chemicals in their work are at the time of their assignment and subsequently every time a new chemical was introduced.  Condition exposed employees to a lack of knowledge regarding the various chemcials they handled during their daily work tasks.
