29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use:  a. On or about January 30, 2014, the painter was required to wear a respirator and the employer did not establish and implement a written respiratory protection program that addressed the worksite-specific procedures such as but not limited to employee medical evaluation, fit testing, and training on the use, maintenance and care of the respirator.

29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employees ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace:  a.  On or about January 30, 2014, an employee who was required to wear a NIOSH approved half-face respirator had not been provided with a medical evaluation prior to wearing the respirator.

On or about January 30, 2014, an employee who was required to wear a NIOSH approved 3M half face respirator had not been fit tested prior to initial use of the respirator.
