29 CFR 1926.502(a)(2): The employer did not provide and install all fall protection systems required by this subpart for employee(s) and did not comply with all other pertinent requirements of this subpart before employee(s) began the work that necessitates the fall protection: On or about January 14, 2014, at building #52, 549 April Dr, Canyon Lake, TX, the employer failed to ensure employee(s) were protected from a fall hazard to the ground below. The guardrail system that was installed was missing toprails, midrails and the top rail could not withstand a 200 pound force from any outward direction. Employee(s) were exposed to a fall hazard of approximately 29 feet to the ground below.

29 CFR 1926.1052(c)(4): Midrails, screens, mesh, intermediate vertical members, or equivalent intermediate structural members were not provided between the top rail of the stairrail system and the stairway steps: On or about January 14, 2014, at Bldg. #52, 549 April Dr., Canyon Lake, TX, the employer failed to ensure employee(s) were protected from a fall hazard. The handrails in the stairwells did not have midrails installed. Employee(s) were exposed to a fall hazard of approximately 9 feet to the lower level on each floor.
