29 CFR 1926.102(a)(1):  Protective equipment, including personal protective equipment for the eye(s) and face were not provided during spraying operations:   On or about January 29, 2014, the employees were exposed to burn hazards and eye irritation in that the employer did not provide all necessary personal protective equipment required to protect employees from sudden flash fires, eye and face irritation.

29 CFR 1910.134(c)(1):  A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use: NOTE:  The requirements applicable to construction work under this paragraph are identical to those set forth at 1926.103.   On or about January 25, 2014, the employer did not establish and implement a written respiratory protection program.  Employees were wearing N95 dust masks and 3M tekk 6211 paint projection respirators while painting.  Employees were exposed to potential respiratory hazards from paint and lacquer fumes.

NOTE:  The requirements applicable to construction work under this paragraph are identical to those set forth at 1926.103:   On or about January 29, 2014, the employer did not ensure that employees who wore 3M tekk 6211 Paint Project Respirator were medically evaluated.  Employees wore the respirators while painting and spray painting lacquer.  This condition exposed employees to potential respiratory hazards from the fumes/vapors.
