29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l).      a) On January 30, 2014, at the worksite located at 7353 Mentor Ave., Mentor, Ohio 44060, the employer allowed an employee to operate a PIV, during recovery operations, whom had not received training and an evaluation on operating such equipment.      b) On and before January 29, 2014, at the shop located at 7840 E. Pleasant Valley Rd., Independence, Ohio 44131, the employer allowed employees to operate a PIV, to load and unload trucks, without providing them with training and an evaluation on the PIV.

29 CFR 1926.251(d)(7): Natural and synthetic-fiber rope slings did not have permanently affixed and legible identification markings that stated the rated capacity, type of fiber material, and the number of legs if more than one.    On or about January 30, 2014, at the worksite located at 7353 Mentor Ave., Mentor, Ohio 44060, the employer allowed his crane operator to use four synthetic web slings that did not have any identification markings that stated the rated capacity for the type of hitch used and the angle upon which it is based, or the type of fiber material, and the number of legs if more than one.
