29 CFR 1910.178(a)(4): Modifications and additions which affect capacity and safe operation shall not be performed by the customer or user without manufacturers prior written approval. Capacity, operation, and maintenance instruction plates, tags, or decals shall be changed accordingly. (a)Avalanche Auto Recycling, LLC @ 1175 So. Kalamath Street, Denver, CO 80223: On or before January 29th, 2014, the employer did not ensure the modification and/or addition of extended forks on the Sit-Down Yale Forklift used for lifting vehicles was permitted by obtaining written approval by the forklift manufacturer. This condition exposed employees to struck-by hazards from improper forklift operations.

29 CFR 1910.178(l)(1)(i): The employer shall ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l). (a)Avalanche Auto Recycling, LLC @ 1175 So. Kalamath Street, Denver, CO 80223: On and before January 29th, 2014, the employer did not ensure each employee who was allowed to operate the Sit-Down Yale Forklift was trained in the safe operation of Powered Industrial Trucks as required under the standard. The owner and a mechanic operated the Yale Forklift without the operators training certification. This condition exposed employees to struck-by hazards from improper forklift operations. Abatement Note: Training shall consist of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace.

29 CFR 1910.178(m)(2): No person shall be allowed to stand or pass under the elevated portion of any truck, whether loaded or empty. (a)Avalanche Auto Recycling, LLC @ 1175 So. Kalamath Street, Denver, CO 80223: On and before January 29th, 2014, the employer did not ensure auto mechanics were protected from crushing hazards associated with being allowed to work under the elevated loaded forks of the Sit-Down Yale forklift. Auto mechanics would elevate the vehicles on the forks of the Yale and conduct maintenance work underneath the vehicle. This condition exposed employees to struck-by hazards and crushing hazards from unsafe forklift operations.
