29 CFR 1926.451(a)(1): Each scaffold and/or scaffold component was not capable of supporting, without failure, its own weight and at least 4 times the maximum intended load applied or transmitted to it:Note:  Exceptions are provided in paragraphs (a)(2), (a)(3), (a)(4), (a)(5) and (g) of this section.    a- 530 Ocean Terrace, Bricktown NJ: On or about 1/31/14, a company employee was exposed to falls greater than 22 feet 5 inches to the ground surface below when working from a ladder jack scaffold where one end of the walking/working surface rested on the ladder jack and the other rested on the walking/working surface of a pump jack scaffold.  The employer could not provide information as to this scaffold's capacity.     NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM.  FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.451(f)(3): Scaffolds and scaffold components were not inspected for visible defects by a competent person before each work shift, and after any occurrence which could affect a scaffold's structural integrity:    a- 530 Ocean Terrace, Bricktown NJ: On or about 1/31/14, a company employee was exposed to falls greater than 22 feet 5 inches to the ground surface below when working from a ladder jack scaffold where one end of the walking/working surface rested on the ladder jack and the other rested on the walking/working surface of a pump jack scaffold.  This set up did not contain any mid/toprails and endstops, and was not rated to be erected as such.     NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM.  FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.454(a): The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards.    a- 530 Ocean Terrace, Bricktown NJ: On or about 1/31/14, a company employee was exposed to falls greater than 22 feet 5 inches to the ground surface below when working from a ladder jack scaffold where one end of the walking/working surface rested on the ladder jack and the other rested on the walking/working surface of a pump jack scaffold.  This set up did not contain any mid/topforails and endstops, and was not rated to be erected as such.  The exposed employee had NOT recieved scaffold training by the company.
