29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: a.) Broadway Avenue FedEx facility, on or about 1/30/14, an employee(s) working at the facility was using a diesel fuel-powered HOTSY power washer to wash delivery trucks for contract drivers. The exhaust from the power washer produces exhaust containing carbon monoxide from the incomplete combustion of the fuel, with additional exposure to carbon monoxide from idling vehicles within the facility. The employer had not addressed the employees' exposure to fuels and combustion products, such as carbon monoxide, as well as other products used for cleaning at the facility such as Goof Off Cleaner (xylene and a glycol ether/serious skin and eye irritation & CNS damage) and developed, implemented and/or maintained at the workplace a written hazard communication program which describes: how labels and other forms of warning; safety data sheets (SDSs); and training will be met. 29 CFR 1910.1200(g)(8): The employer did not ensure that material safety data sheets were readily accessible to the employees in their work area during each work shift: a.) FedEx - On or about 1/30/14, employees use diesel fuel to power the HOTSY power washer used once weekly to power wash delivery trucks at the Fed Ex facility. Additional cleaning chemcials used by employee include, but are not limited to: Goof Off Cleaner (xylenes, ethyl glycol - CNS and serious skin/eye irritation); gasoline (flammable); and, bleach (sodium hypochlorite). The employer did not ensure that all safety data sheets (material safety data sheets) for all chemicals used by the employee, or to which the employees were exposed at all facilites where employees work, were readily accessible to the employees in their work area during each work shift. ABATEMENT CERTIFICATION REQUIRED

29 CFR 1910.1200(h)(3): The employee training did not include the requirements of 29 CFR 1910.1200(h)(3)(i) through (h)(3)(iv): a.) Broadway Fed Ex facility, on or about 1/30/14, employee(s) using a diesel-powered power washer to wash delivery trucks were exposed to carbon monoxide from the incomplete combustion of fossil fuel. The employer does not provide the required training to employees as required by the standard, including: 1.) Methods and observations that may be used to detect the presence or release of a hazardous chemical in the work area (such as monitoring conducted by the employer, continuous monitoring devices, visual appearance or odor of hazardous chemicals when being released, etc.); 2.) The physical, health, simple asphyxiation, combustible dust, and pyrophoric gas hazards, as well as hazards not otherwise classified, of the chemicals in the work area; 3.) The measures employees can take to protect themselves from these hazards, including specific procedures the employer has implemented to protect employees from exposure to hazardous chemicals, such as appropriate work practices, emergency procedures, and personal protective equipment to be used; and, 4.) The details of the hazard communication program developed by the employer, including an explanation of the labels received on shipped containers and the workplace labeling system used by their employer; the safety data sheet, including the order of information and how employees can obtain and use the appropriate hazard information. ABATEMENT CERTIFICATION REQUIRED
