OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were riding in the bucket of an Excavator Track Hoe:   (a)    On January 30, 2014, at a job site located on Leeds Traffic Way west of Emmanuel Cleaver ll Blvd, Kansas City, MO., an employee engaged in water line installation work activities was exposed to serious fall and or struck-by injuries, in that he was observed using the bucket of an excavator to egress from an 8 feet unprotected excavation.    Abatement certification is required for this item; use the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET for this purpose.   NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.21(b)(2): The employer did not ensure each employee was instructed in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury:   (a)    On January 30, 2014, at a job site located on Leeds Traffic Way west of Emmanuel Cleaver ll Blvd, Kansas City, MO., employees had not received adequate training in the recognition and avoidance of unsafe conditions and work practices, in that they were observed working in an unprotected excavation over 8 feet without a safe means of access and were riding in an excavator bucket for egress from the excavation.      Abatement certification for this violation is required.

29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees:   (a)    On January 30, 2014, at a job site located on Leeds Traffic Way west of Emmanuel Cleaver ll Blvd, Kansas City, MO., employees were exposed to serious injuries, in that there was no ladder or other safe means of egress to and from the open excavation approx. 8 feet in depth.     Abatement certification for this violation is not required, abated during the inspection.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section:   (a)    On January 30, 2014, at a job site located on Leeds Traffic Way west of Emmanuel Cleaver ll Blvd, Kansas City, MO., employees were exposed to serious struck by and or engulfment injuries, in that there was no protective systems in use for work being done in an open excavation approx. 8 feet in depth.     Abatement certification for this violation is not required, abated during the inspection.
