29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet (3.1 m) above a lower level shall be protected from falling to that lower level: On or about February 5, 2014, and at times prior thereto at a job site located at 3221 Old Jacksonville Highway, Tyler, Texas 75701, employees working from a scissors lift (Genie, Model GS-2632) were not protected from a fall of more than 16 feet to the concrete below while standing on the midrail.

29 CFR 1926.454(a): The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold used and to understand the procedures to control or minimize those hazards: The employer did not ensure that at least two employees, who were working from a scissors lift on or about February 5, 2014, were trained in the proper use of the scaffold.
