29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average (TWA) sound level of 85 decibels measured on the A scale dB(A), or equivalently a dose of fifty percent:    a)     On or about July 10, 2014, the employer, Harwell Holding, Inc. d/b/a R&R Millwork, Inc. did not implement a hearing conservation program for employees exposed to noise above the action limit of 85.0 dB(A).  An employee was exposed to a noise level of approximately 91.2 dB(A), which was measured over an 8-hour TWA while engaged in metal finishing & polishing operations.      b)     On or about July 10, 2014, the employer, Harwell Holding, Inc. d/b/a R&R Millwork, Inc. did not implement a hearing conservation program for employees exposed to noise above the action limit of 85.0 dB(A).  An employee was exposed to a noise level of approximately 87.6 dB(A), which was measured over an 8-hour TWA while engaged in woodworking operations.        An effective hearing conservation program includes the following items as required by the standard:    1)  A noise monitoring program when employee's exposure exceeds the Action Level of an 8-hour time weighted average of 85 dBA.  Noise monitoring shall be repeated whenever a change in production, processes, or equipment increases the level of exposure.      2)  An audiometric testing program for all employees whose noise exposure exceeds the 85 dBA Action Level.    3)  A training program for all employees who are exposed to noise at levels at the 85 dBA Action Level.

29 CFR 1910.132(a): Protective equipment was not used when necessary whenever hazards capable of causing injury and impairment were encountered:    a)     On or about March 18, 2013, the employer, Harwell Holding, Inc. d/b/a R&R Millwork, Inc. did not provide and require adequate personal protective equipment for so as to protect employees required to spray hazardous chemicals in an enclosed environment from skin and eye contact with the chemicals.
