29 CFR 1926.1428(c)(5): Each signal person did not demonstrate that he/she meet the requirements in paragraphs (c)(1) through (4) of this section through an oral or written test, and through a practical test. The employer does not ensure that each signal person can demonstrate that they meet the requirements in paragraphs (c)(1) through (4) of this section through an oral or written test, and through a practical test. This violation occurred on or about February 3, 2014, at Segment G on Hwy I-45, where each signal person was exposed to struck-by hazards when they had not demonstrated they met the requirements of paragraphs (c)(1) through (4) of this section. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that the signal person meets the requirements in paragraphs (c)(1) through (4) of this section through an oral or written test, and through a practical test.

29 CFR 1926.1430(b): The employer did not train each employee assigned as a signal person who did not meet the requirements of 1926.1428(c) in the areas addressed in that paragraph: The employer does not ensure that employees who are required to be a signal person meet the requirements of 1926.1428(c). This violation occurred on or about February 3, 2014, at Segment G on Hwy I-45, where employees were exposed to struck-by hazards when signaling without receiving training. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that signal persons are trained who do not meet the requirements of 1926.1428(c).
