29 CFR 1910.1030(c)(1)(i): The employer having employee(s) with occupational exposure did not establish a written Exposure Control Plan designed to eliminate or minimize employee exposure:  a. On or about January 28, 2014, employees working as housekeeper were potentially occupationally exposed to bloodborne pathogens while cleaning the Pre-Op, Operating Rooms, and Recovery Areas of the the surgery center and the employer had not developed or implemented a written Exposure Control Plan.

29 CFR 1910.1030(f)(1)(i): The employer did not make available the hepatitis B vaccine and vaccination series to all employees who have occupational exposure:  a. On or about January 28, 2014, employees working as housekeepers at the surgery center were occupationally exposed to bloodborne pathogen hazards while cleaning the Pre-Op, Operation Rooms and Recovery areas, and the employer had not offered the hepatitis B vaccine and vaccination series to all employees who may have occupational exposure.

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:  a. On or about January 28, 2014, employees working as housekeepers at the surgery center used chemicals such as, but not limited to, Windex Glass Cleaner, AF315, Rest Stop, pH7Q Ultra, and Corral Foaming Bathroom cleaner to clean all areas of the surgery center and the employer had not implemented nor maintained a hazard communication program at the workplace which described how safety data sheets, labeling and training requirements were going to be met.

29 CFR 1910.1200(h)(3)(iv):   The details of the hazard communication program developed by the employer, did not include an explanation of the labels received on shipped containers and the workplace labeling system used by their employer; the safety data sheet, including the order of information and how employee could obtain and use the appropriate hazard information:  a.  On or about January 28, 2014, the employer did not include an explanation of the labeling system, and safety data sheet in the training to employees who have exposure to hazardous materials such as but not limited to windex glass cleaner, AF315, Rest Stop, pH7Q Ultra, and Corral Foaming Bathroom cleaner.
