OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck by the powered industrial trucks while working within the merchandise warehouse aisles:    a) Merchandise Warehouse Aisles: On or about 04/02/2014, employees were operating powered industrial trucks in both the vertical and horizontal merchandise warehouse aisleways and had obstructed views around corners when turning from one warehouse aisle into another, and when maneuvering around palletized merchandise stored on both sides of the aisleways while fellow employees were performing stocking and inventory work in the same aisleways.  Among other methods, some of the feasible and acceptable means of abatement are:    1.  Install large convex mirrors at all intersections and areas where the operator cannot see the aisle prior to driving into it.      2.  Place an orange cone at the end of the aisles where employees are working to alert the powered industrial truck operator that there is an employee working within the aisle.    3.  Use a spotter when powered industrial trucks are moving in and around blind spots or into aisleways where other employees are performing work.    4.  Place palletized merchandise on only one side of the aisle at a time so that employees are working one side of the aisle, leaving a clear lane of traffic for the powered industrial trucks.

29 CFR 1910.178(a)(5): The powered industrial truck was equipped with front-end attachments other than factory installed attachments, however the employer did not request that the truck be marked to identify the attachments and show the approximate weight of the truck and attachment combination at maximum elevation with load laterally centered:  a)  Receiving and Warehouse Merchandise Area:  The employer purchased a manlift to be used with their powered industrial trucks and had not marked any of the trucks to identify the attachment and approximate weight of the truck and the attachment combination on any of the truck's plates when employees had used the manlift on the powered industrial trucks.  Abatement Note:  Abatement Documentation is required per 29 CFR 1903.19, in the form of written (i.e. policies, procedures, photos and/or invoices) or other evidence that this items has been corrected.
