29 CFR 1926.451(a)(6): Scaffolds shall be designed by a qualified person and shall be constructed and loaded in accordance with that design. Non-mandatory Appendix A to this subpart contains examples of criteria that will enable an employer to comply with paragraph (a) of this section:      (a)       Salgado Concrete, 2601 Belford Ave., Grand Junction, CO 81501:  On and before January 28, 2014, the employer did not ensure that the supported scaffold was designed by a qualified person, in that the scaffold wood platform was constructed at the job site by non qualified personnel. A skid steer was used to elevate an employee approximately 15 feet on a job made scaffold in order to perform siding work. This condition exposed the employee to a fall hazard of approximately 15 feet.      Abatement Note:  Abatement certification is required for this item (see enclosed Abatement-Certification Letter").

29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used.  Crossbraces were used as a means of access.       (a)           Salgado Concrete, 2601 Belford Ave., Grand Junction, CO 81501:  On and before January 28, 2014, employees were accessing the scaffolding without the use of a ladder. 29 CFR 1926.451(g)(1):  Each employee on a scaffold 10 feet above a lower level was not protected from falling to the lower level:          (a)        Salgado Concrete, 2601 Belford Ave., Grand Junction, CO 81501:  On and before January 28, 2014, the exposing employer did not ensure that employees were protected from a fall from elevation, in that guardrails or other suitable fall protection were not properly installed on the working platform of the scaffolding. 29 CFR 1926.454(a):  The employer did not have each employee who performs work while on a scaffold(s) trained by a person qualified in the subject matter to recognize those hazards associated with the type of scaffold(s) being used and to understand the procedure(s) to control or minimize those hazards:       (a)     Salgado Concrete, 2601 Belford Ave., Grand Junction, CO 81501:  On and before January 28, 2014, the exposing employer did not have each employee who performs work while on a scaffold(s) trained by a person qualified in the subject matter to recognize those hazards associated with the type of scaffold(s) being used and to understand the procedure(s) to control or minimize those hazards. Employees were conducting siding operations on a job made scaffold. This condition exposed the employees to a fall of approximately 15 feet due to recognizing the hazards of working on the scaffold.       Abatement Note: The training shall include the following elements at a minimum:       (1)  The nature of any electrical hazards, fall hazards, and falling object hazards in the work area;       (2)  The correct procedures for dealing with electrical hazards and for erecting, maintaining, and disassembling the fall protection systems and falling object protection systems being used:       (3)  The proper use of the scaffold, and the proper handling of materials on the scaffold;       (4)  The maximum intended load and the load-carrying capacities of the scaffold used; and       (5)  Any other pertinent requirements of this subpart. (a)   Salgado Concrete, 2601 Belford Ave., Grand Junction, CO 81501:  On and before January 28, 2014, did not ensure that employees working at a height greater than 6 feet were provided with an adequate personal fall arrest system. Employees were working on the roof of a shed without the use of fall protection. Employees were seen using a ladder on the roof of the shed in order to conduct siding operations. The ladder was an A frame ladder being used in its collapsed position.
