29 CFR 1903.19(c)(1): Within 10 calendar days after the abatement date, the employer must certify to OSHA (the Agency) that each cited violation has been abated, except as provided in paragraph (c)(2) of this section:   (a)  The employer failed to provide the documentation demonstrating the abatement methods and completion as cited in Citation 1 Item 1 (a) for hazards associated with respiratory protection.  No written program was developed;   (b)  The employer failed to provide the documentation demonstrating the abatement methods and completion as cited in Citation 1 Item 1 (b) for hazards associated with an evaluation for employees to determine if the employee is medically able to use a respirator;   (c)  The employer failed to provide the documentation demonstrating the abatement methods and completion as cited in Citation 1 Item 1(c) for hazards associated with a fit test for employees expected to wear a respirator.

29 CFR 1910.134(c)(1):  A written respiratory protection program that included the provisions in 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use (construction reference 1926.103):     On or about 2/4/14, at the worksite located at 1030 Euclid Avenue, Cleveland, Ohio employees working on the site were required to use respiratory protection when the use of the chute and skid-steer equipment created dusty conditions on the worksite; no written program was developed.

29 CFR 1910.134(e)(1):  The employer did not provide a medical evaluation to determine the employees ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace (construction reference 1926.103):     On or about 2/4/14, at the worksite located at 1030 Euclid Avenue, Cleveland, Ohio, employees working on the site were required to use respiratory protection when the use of the chute and skid-steer equipment created dusty conditions on the worksite; no evaluation was done to determine if the employee is medically able to tolerate the use of a respirator.
