29 CFR 1926.454(a): The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards. At the Tyson Food Facility new kill floor construction project the employer is failing to ensure that employees who operate the articulating boom lift are provided training in accordance with this subpart. Specifically the employees operating a Gene Z-30 Articulating Boom. The Gene Z-30 was provided by the employer for use by employees without providing or ensuring training had been given on this equipment.
